Default About "not satisfied? Money back, no questions asked"

Is this fraud when in commercial they say that if you are not satisfied, they'll give you a full refund no questions asked? I see this done by Brian Kim.

Also can you sue them if they refuse?

Yes, it's fraudulent to make claims that you don't honor. You could sue them, but more effective would be to ask your credit card company to do a charge-back, and post your experience in a public forum to warn others.
